1. Agreement to Terms
By accessing or using FixMyStuff ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.
These Terms apply to all visitors, users, and others who access or use the Service, including customers seeking repairs and repair service providers ("Vendors").
2. Description of Service
FixMyStuff is a marketplace platform that connects customers with independent phone repair service providers in the Los Angeles area. We facilitate communication between customers and Vendors but do not perform repair services ourselves.
Important: FixMyStuff is not a repair shop. We are a referral service. All repairs are performed by independent third-party Vendors who are solely responsible for the quality of their work.
3. User Eligibility
To use our Service, you must:
- Be at least 18 years old or have parental consent
- Be located in the United States
- Provide accurate and complete information
- Not use the Service for any unlawful purpose
4. Customer Terms
4.1 Repair Requests
When you submit a repair request, you agree to provide accurate information about your device and the issue you're experiencing. Inaccurate information may result in incorrect quotes or service refusal.
4.2 Vendor Relationships
Any repair agreement you enter into is directly between you and the Vendor. FixMyStuff is not a party to this agreement and is not responsible for:
- The quality of repairs performed
- Parts used in repairs
- Warranties offered by Vendors
- Pricing or payment disputes
- Damage to devices during repair
- Data loss or privacy issues
4.3 Device Buyback
If you sell a device through our buyback program, you represent that:
- You are the legal owner of the device
- The device is not stolen or subject to any liens
- The device is not locked to any carrier or account (unless disclosed)
- All information provided about the device's condition is accurate
Final buyback prices may be adjusted based on physical inspection of the device.
5. Vendor Terms
5.1 Vendor Responsibilities
Vendors who join our network agree to:
- Maintain all required business licenses and insurance
- Provide accurate pricing and service information
- Respond to customer inquiries in a timely manner
- Perform repairs with reasonable skill and care
- Honor any warranties or guarantees offered
- Comply with all applicable laws and regulations
5.2 Lead Fees
FixMyStuff may charge fees for leads or completed transactions. Fee structures will be communicated to Vendors upon registration and may be modified with 30 days notice.
6. Prohibited Activities
You agree not to:
- Use the Service for any illegal purpose
- Submit false or misleading information
- Impersonate another person or entity
- Interfere with or disrupt the Service
- Attempt to gain unauthorized access to any part of the Service
- Use automated systems to access the Service without permission
- Circumvent the platform to avoid fees (for Vendors)
- Harass, abuse, or harm other users
7. Intellectual Property
The Service and its original content, features, and functionality are owned by FixMyStuff and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
You may not copy, modify, distribute, sell, or lease any part of our Service without explicit written permission.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Service will be uninterrupted, secure, or error-free
- Results from using the Service will be accurate or reliable
- Any Vendor will provide satisfactory service
- Any defects will be corrected
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIXMYSTUFF SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- Your use or inability to use the Service
- Any conduct or content of any third party on the Service
- Unauthorized access, use, or alteration of your information
- Any repair services provided by Vendors
- Any damage to your device during repair
Our total liability shall not exceed the amount you paid to FixMyStuff, if any, in the past twelve months.
10. Indemnification
You agree to defend, indemnify, and hold harmless FixMyStuff and its officers, directors, employees, and agents from any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the Service or violation of these Terms.
11. Dispute Resolution
11.1 Disputes with Vendors
Any disputes regarding repair services should be resolved directly with the Vendor. FixMyStuff may assist in facilitating communication but is not obligated to resolve disputes.
11.2 Disputes with FixMyStuff
Any dispute arising from these Terms or the Service shall be resolved through binding arbitration in Los Angeles County, California, in accordance with the rules of the American Arbitration Association.
Class Action Waiver: You agree to resolve disputes individually and waive any right to participate in a class action lawsuit or class-wide arbitration.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of significant changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.
14. Termination
We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately.
15. Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
